BluOS.io (“BluOS”, “we”, “our”, or “us”) provides the BluOS operating system, firmware, software, APIs, and related technologies that are licensed or deployed by third-party brands (manufacturers, OEMs, integrators), as well as services (apps, cloud linking, analytics). This Privacy Policy describes how we collect, use, disclose, retain, and protect information in connection with BluOS and related services. This policy should be read together with the terms of use, license agreements, and other policies of the brand or product that uses BluOS.

By using BluOS (via a BluOS device, app, or a product from a brand implementing BluOS) or accessing our website(s), you agree to this Privacy Policy.

Information We Collect

We collect information either:
• that you actively submit to us (e.g. via registration, support forms, linking services), or
• that is collected automatically by our software / devices (usage data, diagnostics)

Information You Submit

You may provide us (or provide through a third-party brand) with:
• Contact information (name, email, mailing address, phone)
• Account credentials (username, password, login information)
• Device registration information (device model, serial number, firmware version)
• Preferences, settings, and features you choose
• Linked service credentials or tokens (e.g. streaming service tokens)
• Communications (support requests, feedback, correspondence)

Automatically Collected / Technical / Usage Data

When BluOS software or app runs (or via devices), we may collect:
• Device metadata: model, hardware identifiers, firmware/software version
• Network connectivity: IP address, MAC address, WiFi / network signal strength
• Usage analytics: which features you use, usage duration, logs of interactions
• Diagnostic / error reports / crash logs
• Telemetry: health metrics, performance statistics
• Cookies, pixels, or other tracking on our web pages

We may aggregate or de-identify data so that it cannot reasonably be used to reidentify an individual.

How We Use the Information

• Operating, maintaining and improving BluOS (firmware updates, feature enablement)

Cookies, Tracking & Web Technologies

On our websites (or any BluOS-branded web interface):
• We use cookies, tracking pixels, and similar technologies (e.g. Google Analytics, advertising pixels) to measure usage, personalize content, deliver relevant offers, and enable features.
• Essential cookies (required for site functionality) cannot be disabled. Other cookies (functionality, performance, advertising) may be optional or controllable via your cookie preferences.

Retention & Deletion

We retain personal information as long as necessary for the purposes described above, or as required by law.

When information is no longer needed, it will be securely deleted, de-identified, or anonymized.

You may request deletion of your account or personal data (subject to legal or technical constraints).

Product & Service Data Disclosure (EU Data Act)

In accordance with Regulation (EU) 2023/2854 (the EU Data Act), BluOS provides the following disclosures regarding connected products and related services that utilize the BluOS operating system, firmware, or associated software and services.

Types of Data Generated: BluOS-enabled products may generate the following categories of data during normal operation:
– Usage logs (e.g., when and how features are used, device telemetry)
– Playback metadata (e.g., track identifiers, elapsed time)
– Error and diagnostic reports
– Firmware version
– Connectivity metadata (e.g., timestamps, device identifiers, IP addresses)

Format and Metadata: Data will be provided in commonly used, machine-readable formats (for example, JSON or CSV). Associated metadata such as timestamps, device identifiers, and version numbers will accompany the data to ensure usability.

Estimated Data Volume: Typical data generated by a product ranges from approximately 10 KB to 300 KB per day, depending on individual usage patterns.

User Access: You may request access to the data generated by your product free of charge. Data will be provided in a commonly used, machine-readable format, together with metadata. To submit a data request, navigate to Settings > Privacy > Data Request in the BluOS app, or use the available online data request form at bluos.io/contact.

Third-Party Sharing at Your Request: You may request that BluOS share data generated by your product with a third party of your choice. Such data will be shared in the same machine-readable format. BluOS may only refuse such a request if required by law or where disclosure would cause serious and demonstrable harm to trade secrets. In such cases, a written explanation will be provided.

Updates and Changes: If a software or firmware update changes which data your product generates or how that data can be accessed, BluOS will notify you in advance or at the time of the update, explaining the nature of the change.

Depending on your jurisdiction, you may have rights including:
• Access to your personal data
• Correcting or updating inaccurate data
• Deleting your data / account
• Limiting or objecting to certain processing
• Withdrawing consent (if applicable)
• Portability of data in machine-readable format
• Opting out of analytics / telemetry (where supported)

Security

We deploy reasonable technical, administrative, and organizational measures to protect your information from unauthorized access, misuse, alteration, or destruction. However, no system is perfect, and absolute security cannot be guaranteed.

International Transfers

Because BluOS is used globally, your information may be transferred to, stored in, or processed in jurisdictions other than your own (e.g. Canada, U.S., EU). Where required by law, we will ensure appropriate safeguards (standard contractual clauses, encryption, etc.) for such transfers.

Children

Our offerings are not directed to children under the age of 13 (or local age threshold). We do not knowingly collect personal information from minors without parental consent. If we learn we’ve collected data from a child, we will promptly delete it.

Changes to This Privacy Policy

We may modify this Privacy Policy at any time. When we make material changes, we will update the “Last updated” date and may notify users (via app, email, or website). Continued use after changes indicates acceptance.
